These Terms of Use and this Privacy Policy are effective on this Web site: This Website is owned, operated and controlled by Globibo Media (“GM”), a brand of Digital-Media-Lab Pte Ltd. By accessing or using the Website or any derived content or applications you agree to have read, understood and to be bound by these terms and conditions ("Terms of Use").


The Terms of Use may be amended from time to time without prior notice and affect your legal rights and obligations, subject to the terms set out below. If you do not agree to be bound by all of these Terms of Use, do not access or use the Service.This Privacy Policy governs the manner in which the Web site collects, uses, maintains and discloses information collected from users (each, a "User"). This privacy policy applies to the Site and all products and services offered by GM.


1. SCOPE OF OUR SERVICE

Through the Website we provide an online platform through which all types of beauty,wellness and training service providers, for example; spas, wellness studios, nail studios, cosmetic studios, hair dressers, training companies, language schools, (collectively the "Principle(s)"), can advertise their services for reservation, and through which visitors (“Customer”, “you”) to the Website can make such reservations after registration. By making a reservation through the Web site, you enter into a direct (legally binding) contractual relationship with the Principle at which you book. From the point at which you make your reservation, we act solely as an intermediary between you and the Principle, transmitting the details of your reservation to the relevant Principle and sending you a confirmation email for and on behalf of the Principle. The reservation is valid from the point of its booking online and independent from any confirmation send.


When rendering our Services, the information that we disclose is based on the information provided to us by the Principle. As such, the Principles are given access to our system through which they are fully responsible for updating all rates, availability and other information which is displayed on our Website. Although we will use reasonable effort and care in performing our services we will not verify if, and cannot guarantee that, all information is accurate, complete or correct, nor can we be held responsible for any errors (including manifest and typographical errors), any interruptions (whether due to any (temporary and/or partial) breakdown, repair, upgrade or maintenance of our Website or otherwise), inaccurate, misleading or untrue information or non-delivery of information. Each Principle remains responsible at all times for the accuracy, completeness and correctness of the (descriptive) information (including the rates and availability) displayed on our Website. Our Website does not constitute and should not be regarded as a recommendation or endorsement of the quality, service level, qualification or (star) rating of any service made available.


Our services are made available for personal and non-commercial use only. Therefore, you are not allowed to re-sell, deep-link, use, copy, monitor, display, download or reproduce any content or information, software, products or services available on our website for any commercial or competitive activity or purpose.


2. REGISTRATION AND CUSTOMER’S ACCOUNT

The Customer can register to make a booking via the Website. When registering for the use of the Services, the Customer agrees to provide true, accurate, current and complete information as prompted by the registration process and as requested from time to time by GM. Once registration has been accepted, a username and password will be created and supplied to the Customer in order to provide access to the Services. The Customer authorises GM to use his personal data in order to enable the contact between the Principle and the Customer.


Customers are allowed to link to third-party application accounts, such as Facebook, Twitter and Instagram, either on creation of the Customer’s account or at future authorisation. The Customer permits GM to make publications in third-party applications for means of advertisement, without violation of the terms and conditions of these third-party application accounts. By granting GM access to third-party accounts, the Customer acknowledges that GM may access, deliver and store (if applicable) any content that the Customer has provided and stored in his third-party account, so that it is available through his account. The account/profile of every Customer is personal and not transferable. GM reserves the right to delete an account without any justification and prevent further use of the Services by blocking access to the Web site. Blocked Customers are not allowed to create new profiles or accounts. The Customer is granted the right to request, at any time, his account cancellation. To do so, he must provide GM with a written notification sent via email stating his full name and registration details with a request to cancel his account.


3. PRICES

All prices on the Website are the final amount to be charged, including VAT/GST and all other applicable taxes (subject to change of such taxes).The prices listed include no additional fees or charges. The Principles pay a commission to the Web Site after the fulfilment of the Service. Obvious errors, omissions and mistakes (including misprints) are not binding.


4. PAYMENT, ADJUSTMENTS TO BOOKING AND CANCELLATION

There are 2 payment options for you :

  1. Reservation Deposit (only) :Upon payment of the reservation deposit (only), the outstanding amount will be collected from the Principle. Once the reservation is made, the Customer is obliged to arrange for the appointment with the Principle and to pay the outstanding amount precisely as specified on the Web Site for the specific booked Service directly to the Principle. A future cancelation is subject to your agreement with the Principle and the original reservation deposit is not refundable.

  2. Full payment :If the customer pays the Service in full on the Web site, any refund will have to be requested from the Web Site. If the Customer wishes to review or adjust the booked Service, please contact our customer service via email. Please note that an adjustment, concerning the appointment can be made up to 48 hours before the appointment, by the customer, after that the Customer will be charged for the cancellation or having not shown up to the scheduled appointment. Upon cancelation GM will consult the Principle in regards to status of Customer’s appointment.

5. PRIVACY AND COOKIES

6. REVIEWS

Customers can post reviews concerning the Principle on our Website. Reviews must be based on concrete facts, be fair and objective and not contain any type of content that might be considered as defamatory, offensive, abusive, infringing intellectual property rights or illegal. The completed customer review may be uploaded on our website for the sole purpose of informing future customers of your opinion of the service level and quality of the Service and wholly or partly used and placed by the Web Site at its sole discretion, e.g. for marketing, promotion or improvement of our service, on our website or such social media platforms, newsletters, special promotions, apps or other channels owned, hosted, used or controlled by the Web Site. We reserve the right to adjust, refuse or remove reviews that violate the conditions set out above. On any concern in regards to a review posted online, you can contact us any time to review, edit and/or delete the comments.


7. DISCLAIMER

Nothing in the Terms of Use shall exclude or in any way limit our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited. Subject to the limitations set out in these terms and conditions and to the extent permitted by law, we shall only be liable for direct damages actually suffered, paid or incurred by you due to an attributable shortcoming of our obligations in respect to our services, up to an aggregate amount of the aggregate cost of your reservation as set out in the confirmation email (whether for one event or series of connected events).


However and to the extent permitted by law, neither we nor any of our officers, directors, employees, representatives, subsidiaries, affiliated companies, distributors, affiliate partners, licensees, agents shall be liable for (i) any punitive, special, indirect or consequential loss or damages, any loss of production, loss of profit, loss of revenue, loss of contract, loss of or damage to goodwill or reputation, loss of claim, (ii) any inaccuracy relating to the (descriptive) information (including rates, availability and ratings) of the Services as made available on our website, (iii) any (direct, indirect, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, pursuant to, arising out of or in connection with the use, inability to use or delay of our website, or (iv) any (personal) injury, death, property damage, or other damages, losses or costs suffered, incurred or paid by you, whether due to (legal) acts, errors, breaches, (gross) negligence, wilful misconduct, omissions, non-performance, misrepresentations, tort or strict liability by or (wholly or partly) attributable to the Principle.


8. INTELLECTUAL PROPERTY RIGHTS

GM allows its Users to post content, photos, comments, add links and other materials, provided that such posting is conducted in accordance with the law of Singapore, including but not limited to the Copyright Act (Cap. 63). Anything Users post or otherwise make available on our Website is referred to as “User Content”. Users retain all rights and are solely responsible for the User Content posted on our website. User Content, if not original, must have the requisite licences. In the event that any User Content is found to be infringing, Users agree to indemnify the Web site and GM from any liability caused by such infringing actions, including any costs and damages arising therefrom. By submitting content onto the Website, Users grant GM an exclusive, royalty-free, transferrable, sub-licensable, worldwide licence to use, store and display, reproduce, re-publish, modify, create derivative works, perform and distribute User Content. Nothing in these Terms shall restrict other legal rights GM may have to User Content, for example under other licenses. We reserve the right to remove or modify User Content for any reason, including User Content that we believe violates these Terms or our policies.


Complaints regarding content posted on the GM Web site :GM respects the intellectual property rights of others and desires to offer a platform that is free of violation of these rights. Our User Terms and Conditions require that information posted by users be accurate, lawful and not in violation of the rights of third parties. To promote these objectives, GM provides a process for submission of complaints concerning content posted by our Users. Please note that in the event GM receives a complaint, GM reserves the right to forward the complaint and the complainant’s contact information to the User who allegedly posted the content under complaint. GM also reserves the right to disable, suspend and/or terminate the accounts of Users, at any time pending investigations into the actions complained of, and/or where the complaint is found to be valid. Please note that any complaint submitted must be made in good faith and is true to the best of Users’ knowledge. A false complaint may give rise to personal liability for defamation and groundless threat of infringement, among other things. Users may therefore want to seek the advice of legal counsel before submitting a complaint. To assist GM in investigating complaints, please ensure that any such complaints contain the following information :- A description of the work that has allegedly been infringed including its date of creation; A description specifying the location on our website of the allegedly infringing material; Your email address and your mailing address and/or telephone number; A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner; A statement by you that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.


Unless stated otherwise, the software required for our services or available at or used by our Website and the intellectual property rights (including the copyrights) of the contents, information and material on our website are owned by GM.


The Web Site exclusively retains ownership of all rights, title and interest in and to the Website on which the Service is made available (including the Customer reviews) and you are not entitled to copy, scrape, link to, publish, promote, market, integrate, utilize, combine or otherwise use the content or our brand without our express written permission. To the extent that you would wholly or partly use or combine our content (including Customer reviews) or would otherwise own any intellectual property rights in the website or any content or Customer reviews, you hereby assign, transfer and set over all such intellectual property rights to the Web Site. Any unlawful use or any of the aforementioned actions or behaviour will constitute a material infringement of our intellectual property rights (including copyright and database right).

9. MISCELLANEOUS

To the extent permitted by law, these terms and conditions and the provision of our services shall be governed by and construed in accordance with Singapore law and any dispute arising out of these general terms and conditions and our services shall exclusively be submitted to the competent courts in Singapore.


If any provision of these terms and conditions is or becomes invalid, unenforceable or non-binding, you shall remain bound by all other provisions hereof. In such event, such invalid provision shall nonetheless be enforced to the fullest extent permitted by applicable law, and you will at least agree to accept a similar effect as the invalid, unenforceable or non-binding provision, given the contents and purpose of these terms and conditions.

We may collect personal identification information from Users in a variety of ways, including, but not limited to, when Users visit our site, register on the site, place an order, subscribe to the newsletter, respond to a survey, fill out a form, and in connection with other activities, services, features or resources we make available on our Site.
